The senator’s critique centers on the bill's inability to prevent regulatory arbitrage and protect the broader financial system from the influence of large digital asset firms. Warren has specifically highlighted the need for stricter provisions against political corruption, particularly in light of recent scrutiny regarding the crypto holdings of senior elected officials, including President Donald Trump. Warren previously demanded that Trump disclose his earnings from ventures like World Liberty Financial, citing concerns that personal financial interests could compromise legislative integrity.

Senate Majority Leader John Thune declined to file for cloture on the bill this week, effectively stalling its progress toward a floor vote before the upcoming August recess. With the legislation absent from the Senate's immediate priorities, prediction markets have reacted sharply; Polymarket now estimates only a 17% probability of the bill becoming law in 2026. Negotiators continue to face a 60-vote threshold, requiring a level of bipartisan consensus on ethics and agency oversight that remains elusive.
