ASX Shareholder Seeks Court Greenlight to Sue Former Directors
Rosherville Pty Ltd has formally notified the Australian Securities Exchange of its intent to seek Federal Court permission to pursue legal action against former officers and directors. The move marks a new chapter in the fallout from the exchange's abandoned, multi-million dollar CHESS replacement project.

This legal challenge follows a costly regulatory defeat for the exchange. In July, Justice Markovic ordered ASX to pay A$20.5 million in penalties after the company admitted to misleading the market regarding the status of the CHESS project. At the time of the misleading 2022 statements, internal reports had already flagged the project as failing, leading to a subsequent write-off of up to A$255 million. As the company pivots to a new platform developed by Tata Consultancy Services, the court must now decide whether to hold individual former leaders accountable for the governance failures that derailed the original initiative.
