Capricor Therapeutics Faces Shareholder Lawsuit Following Trial Data Dispute

Investors who suffered substantial losses in Capricor Therapeutics have until September 28, 2026, to seek lead plaintiff status in a pending class action lawsuit. The litigation follows a sharp 64% collapse in share price triggered by revelations that the company altered clinical trial protocols without federal regulatory approval.

The legal scrutiny centers on a period between December 17, 2025, and July 26, 2026, during which Capricor allegedly misled investors regarding the efficacy of its Duchenne muscular dystrophy drug candidate, Deramiocel. While the company initially reported positive Phase 3 results in late 2025—driving a 370% stock surge—subsequent FDA briefing documents revealed that management modified the statistical analysis plan without the agency's consent. The FDA ultimately concluded that the study failed to meet its primary and secondary endpoints.

Management reported a $40.7 million net loss for the second quarter of 2026, opting to forgo the traditional analyst Q&A session during its earnings call. The company cited sensitive ongoing discussions with the FDA as the reason for the silence. Hagens Berman, the firm leading the investigation, is now evaluating how executives characterized trial data and undisclosed modifications to the study's framework. Investors who acquired securities during the specified window are encouraged to contact the firm to discuss potential recovery options ahead of the late September court deadline.
