House Republican leadership has canceled eight legislative days in late September, effectively forcing the chamber to depart Washington on September 17. This sudden shift in the voting calendar creates a narrow window for the CLARITY Act, leaving little room for the Senate to pass any amendments before the midterm elections.

The House majority whip, Tom Emmer, notified members that voting sessions scheduled for the weeks of September 21 and 28 have been removed from the calendar. With representatives slated to return from Labor Day for only four days of work, the path for the digital asset legislation has narrowed significantly. While the Senate is expected to hold a procedural cloture vote on September 15, clearing that hurdle is only the beginning of a complex legislative process.

Should the Senate pass an amended version of H.R. 3633, the House would be required to reconcile the differences before the bill could reach President Donald Trump. Negotiators remain deadlocked over several contentious issues, including stablecoin rewards, anti-money laundering requirements, and decentralized finance oversight. Banking interests argue that current incentive structures allow crypto platforms to bypass capital requirements, while industry advocates maintain that strict prohibitions would stifle competition.

Market participants have grown increasingly skeptical of a breakthrough before the session ends. Polymarket traders currently peg the probability of the bill becoming law at roughly 17%, down from higher estimates earlier this summer. If lawmakers fail to bridge these gaps before the November 3 midterms, the legislation will likely stall until a new Congress convenes. Meanwhile, SEC Chair Paul Atkins continues to push forward with separate, agency-led rulemaking, including the proposed 402-page Regulation Crypto Assets framework, regardless of the bill’s fate on Capitol Hill.
