Nicolas Sansone, an attorney with Public Citizen Litigation Group, stated that the administration is operating without a legal foundation. He noted that the project requires approval from the National Capital Planning Commission, a hurdle the White House has yet to clear. Sansone emphasized that until Congress explicitly authorizes the construction, any preparatory work remains unauthorized.
Representative Don Beyer, whose district includes the area near Arlington National Cemetery, labeled the proposal an illegal and narcissistic project. He warned that the structure would impede local traffic and disrupt the historical sightlines of the capital. While a recent National Park Service report acknowledged that the arch would negatively affect the integrity of nearby landmarks, the administration continues to frame the monument as a significant architectural addition to the city.
