Attorney General William Tong and Banking Commissioner Jorge Perez released a consumer alert on Sept. 3, identifying seven offshore platforms—GMX, Gains Network, dYdX, Aevo, Drift Protocol, Vertex Protocol, and Hyperliquid—as examples of services operating beyond federal safeguards. While officials clarified that none of these specific platforms were directly linked to the $200,000 loss, they serve as warnings for a sector where users often have no recourse in the event of fraud, security breaches, or platform failures.
The alert emphasizes that many offshore exchanges offer high-risk products, including perpetual contracts with leverage as high as 250x and synthetic exposure to U.S. stocks. Unlike regulated domestic exchanges, these venues often bypass identity verification, creating environments conducive to money laundering and sanctions evasion. Furthermore, because these products track asset prices without granting actual ownership rights, traders remain vulnerable to the platform's internal management, potential price manipulation, and sudden liquidity freezes.
