Legal Groups Press Biden to Solidify Guantánamo Plea Deals

Col. Matthew N. McCall issued a 29-page ruling this week, declaring that Defense Secretary Lloyd Austin exceeded his authority when he unilaterally withdrew from agreements that would have spared Khalid Sheikh Mohammed, Walid bin Attash, and Mustafa al-Hawsawi from the death penalty in exchange for life sentences. The judge asserted that the deals remain legally binding, effectively forcing the administration to choose between accepting the resolution or initiating a potentially protracted legal challenge.

Advocacy organizations, including the ACLU and the Center for Constitutional Rights, argue that the administration should embrace the ruling to bring finality to decades of litigation. Anthony D. Romero of the ACLU stated that the plea process is the only practical path toward transparency for victims' families. Meanwhile, the Center for Constitutional Rights emphasized that 16 of the 19 uncharged men held at the site have already been cleared for transfer by government agencies, urging the White House to prioritize their relocation before the transition of power in January.
