Brown, who chaired the Senate Banking Committee from 2021 to 2025, previously established a record of opposition to crypto-sector proposals, citing concerns over money laundering and consumer protection. His current bid for an Ohio Senate seat against incumbent Republican Jon Husted has become a focal point for industry donors seeking to prevent his potential return to committee leadership.

While Brown held his seat for 18 years before losing to Bernie Moreno in 2024, his seniority status remains uncertain should he win this special election. Senate rules typically treat service as interrupted for returning members, though Democratic leadership could theoretically grant exceptions. Meanwhile, the contest has already seen nearly $300 million in advertising commitments, establishing it as one of the most expensive races in the country. Fairshake, which entered 2026 with over $193 million in reserves, previously spent $40 million in 2024 to help secure Moreno’s victory over Brown, cementing the state as the group's primary battleground.
