Lummis Accuses Senate Democrats of Blocking Agreed Crypto Safeguards

Senator Cynthia Lummis is renewing her push against Senate Democrats, accusing them of obstruction for rejecting the CLARITY Act. Despite integrating 126 requested changes into the bill—including tighter enforcement and FTX-style custody rules—the legislation failed a September procedural vote, leaving the future of digital asset oversight in legislative limbo.

The dispute centers on a September 15 procedural vote where the bill fell short of the 60 votes required to begin formal debate, failing 49–50. Lummis argues that the measure addresses key Democratic demands, such as higher civil monetary penalties for digital asset violations and stricter oversight of exchange-issued tokens. She contends that these provisions specifically target the vulnerabilities exposed by the collapse of FTX, effectively codifying protections that Democrats previously championed in committee.

Democratic lawmakers maintain that the opposition is rooted in broader concerns rather than a rejection of consumer protections. Senators including Ruben Gallego and Catherine Cortez Masto have cited unresolved ethics rules, potential conflicts of interest regarding the Trump family’s crypto interests, and disagreements over the enforcement scope of the Commodity Futures Trading Commission. While seven Democratic senators have expressed a desire to resume negotiations, no date for a new vote has been set. As the legislative process remains stalled, federal agencies continue to navigate the space using existing regulatory authority, a path critics argue lacks the permanence and legal clarity of a comprehensive congressional mandate.
