Wisconsin Attorney General Josh Kaul has consistently characterized these platforms’ sports event contracts as unlicensed gambling, arguing that federal registration does not grant immunity from state statutes.
Conflict Over Jurisdictional Boundaries
Griesbach’s ruling asserts that Wisconsin’s gambling laws do not conflict with or face preemption by federal commodities regulations. This puts the CFTC in a difficult position, as it currently faces pressure from a coalition of 44 state attorneys general who argue that the agency has overstepped its authority by attempting to regulate markets traditionally governed by states. Ohio Attorney General Andy Wilson, who led the coalition, contends that Congress never authorized the federal government to overtake gambling oversight.
